Khap Panchayats, Custom & Constitutional Morality

Can a community justify interference with an adult couple’s choice of marriage in the name of custom, tradition or religious practice?

The Supreme Court’s approach in Shakti Vahini v. Union of India makes the position clear: customary or social morality cannot override constitutional rights.

Article 25 guarantees freedom of conscience and the right to profess, practise and propagate religion. However, this freedom is subject to public order, morality, health and the other Fundamental Rights under Part III.

Therefore, Article 25 cannot be used as a justification for threats, coercion, social boycott or violence against adults exercising their choice of partner.

An important distinction must be maintained:

Custom ≠ Fundamental Right.
Social morality ≠ Constitutional morality.
Community honour ≠ Individual dignity.

The Constitution protects the individual’s liberty, dignity and autonomy, and no Khap Panchayat or community can take the law into its own hands in the name of honour or tradition.

A Bird is not meant to be caged it's meant to fly.

Its natural habitat is not a cage but the wild.

If you see the practice happening ,don't buy because selling of Red-Ringed Parakeet is prohibited under Section 9 Of The Wildlife Protection Act as a part of Schedule II Listed animals.

As per Section 2(1) Birds are included in the definition of animals.

Hunting as per Section 2(16) also includes snaring , capturing.

Next time if you see this type of trade practice Please don't encourage it.
Report it to the Wildlife Authorities or Forest Department so that they can take required measures.

They have wings to fly, just as we have limbs to move. Taking away their freedom to fly is like taking away our freedom to move.

Article 14 — Equality before law
Manual scavenging disproportionately affects people from historically marginalised communities and pushes them into degrading and hazardous work.


Even though the law guarantees equality before law and equal protection of laws, a system where one section of society is effectively forced into unsafe, degrading labour raises a serious Article 14 concern.


The issue is not merely unequal treatment by the State. Failure to provide equal protection and effective enforcement of the prohibition can also undermine substantive equality.

Article 21 — Right to life and dignity
This is the stronger constitutional violation.


Article 21 protects not merely physical existence, but the right to live with human dignity.


When a person is required to enter a sewer or septic tank, often without adequate safety equipment, they are exposed to poisonous gases, serious injury and death.


The Supreme Court has therefore connected eradication of manual scavenging with the constitutional guarantee of dignity under Article 21.
