A LIFE THAT CHANGED A NATION

Today, we remember Steve Biko, one of the most influential voices of South Africa’s struggle against apartheid.

Biko was a founding member of the South African Students’ Organisation (SASO) and a leading figure in the Black Consciousness Movement of the 1970s. Through his words, leadership and unwavering belief in the dignity of black people, he challenged a system designed to suppress, divide and dehumanise.

On 12 September 1977, Steve Biko died in police custody at just 30 years old. His life was tragically cut short, but the ideas he championed did not die with him.

His message of self-worth, dignity, freedom, equality and psychological liberation became an important part of South Africa’s history and continues to provoke reflection decades later.

Today, we pause to remember the man, acknowledge his contribution and reflect on the enormous impact of his life.

Steve Biko was only 30. His life was short. His legacy was not.

May his memory continue to remind us that the struggle for dignity, justice and freedom is ultimately a struggle about the value of every human being.

A joint operation involving the Flying Squad and Crime Intelligence has led to the seizure of 41,000 mandrax tablets, with an estimated street value of R2.05 million. Police say the drugs were allegedly being transported from Johannesburg to Cape Town in a Volvo truck. DEVELOPING: ARRESTS FOR ANTI-IMMIGRATION PROTESTS? BUT WHERE DOES PROTEST END AND “INSTIGATION” BEGIN?

President Cyril Ramaphosa says law-enforcement authorities are following up on reports and evidence relating to violence against African foreign nationals.

The President says those identified as having perpetrated or instigated such violence will be pursued, with arrests and criminal charges expected where evidence supports violations of the law, including cases where people have been injured or killed.

But this raises a much bigger and more uncomfortable question for South Africa.

WHERE EXACTLY IS THE LINE BETWEEN PROTEST, POLITICAL SPEECH, INCITEMENT AND CRIMINAL INSTIGATION?

Names such as Jacinta Ngobese-Zuma and Phakel Umthakathi have become closely associated with the current anti-illegal-immigration mobilisation, and their supporters are already asking:

If arrests are coming, who exactly will be arrested, and on what evidence?

Will organisers be held criminally responsible for violence committed by individuals at protests?

Or will authorities have to establish that a particular organiser directly encouraged, planned, ordered or intentionally contributed to unlawful violence?

Because there is another side to this debate.

South Africa's Constitution protects the rights to freedom of expression, assembly and peaceful demonstration.

At the same time, those rights do not provide protection for violence, threats, destruction of property or the deliberate incitement of people to commit crimes.

So the question is not simply:

“SHOULD PEOPLE BE ARRESTED?”

The more important question is:

“WHAT EXACTLY DID THEY DO AND WHAT EVIDENCE DOES THE STATE HAVE?”

And then there is the reaction coming from some members of the public:

“If you arrest them, be ready to arrest all of us.”

Is this simply anger and political solidarity?

Or does it demonstrate just how deeply divided South Africa has become over immigration, undocumented migration and the government's response to public frustration?

There is also a question that cannot be ignored:

CAN SOUTH AFRICA CRACK DOWN ON VIOLENCE WITHOUT CRIMINALISING LEGITIMATE PROTEST?

If someone commits violence, prosecute them.

If someone destroys property, prosecute them.

If someone directly incites violence and the evidence meets the legal threshold, prosecute them.

But if someone is merely expressing opposition to government immigration policy or participating in a peaceful demonstration, should that automatically be treated as criminal conduct?

And perhaps the biggest test for law enforcement will be consistency.

WILL THE LAW BE APPLIED EQUALLY TO EVERYONE, REGARDLESS OF WHETHER THEY ARE PROTESTERS, POLITICAL LEADERS, FOREIGN NATIONALS OR SOUTH AFRICAN CITIZENS?

South Africa may now be approaching a critical moment.

The government says arrests will follow where evidence exists.

The protesters say they are demanding action on issues they believe government has ignored.

And the public is asking:

WHERE IS THE LINE?

PROTEST OR INSTIGATION?
POLITICAL SPEECH OR INCITEMENT?
LAW ENFORCEMENT OR POLITICAL CRACKDOWN?
