The EHRC guidance about public ‘single-sex’ spaces being used based on assigned birth sex, has now come into effect in the UK. But remember, it’s guidance, not law.
The guidance states that trans people should either use the facility that matches their assigned birth sex, or a gender neutral facility.
If followed, this guidance will push trans women into men’s spaces, and trans men in women’s.
However, you do not have to tell a service provider your assigned sex, and they cannot ask to see ‘proof’ of your sex via things like passports.
Trans people have been using the public gendered spaces in correlation with their gender identity for decades. Research literally shows that trans inclusive policies do NOT cause any safety concerns (Hasenbush et al., 2019).
This is nothing but unworkable, unenforceable transphobia and segregation of trans people within public life.
As a trans man who has been using the men’s facilities for 15 years, I will be continuing to do so.
