This case has confirmed my long held suspicion regarding the unfortunate inherent sleaziness of the practice of criminal defense law. In cases like this, they work against society. In seeking to find a loophole to free someone like RA, they hope to game the system and so enrich themselves in terms of professional notoriety, which of course means $$$. Great for them as individuals but this comes at the expense of the rest of us.

Adding insult to injury, professional wins that would be normally celebrated discreetly amongst colleagues now become a cynical performance played out on social media. I’ve said this before but the worst thing about the Delphi lawyer-influencers is that they think so little of their viewers that rather than couch their arguments correctly as efforts to find a loophole, they feign belief in the absolute innocence of every criminal they cover. They think their audience isn’t sophisticated enough to appreciate their efforts to game the system, which after all, is the point of their role as defense lawyers. Or maybe they like playing to the lowest common denominator.

I’d have more respect for them (or, at least I’d have a trace of grudging respect) if they’d just say, “Allen’s guilt is irrelevant to us. We’re just here to make a name for ourselves/make money, so behold our admirable verbal contortions as we attempt to beat the system!”

This is part of the reason why seeing this appeal attempt fail spectacularly will be so satisfying.
