If you’ve been checking the Visa Bulletin every month for years, this is the one you’ve been waiting for.
In November, F1, F2B, F3 and F4 moved a full year forward for most countries. F2A moved one month, and it’s current on the Dates for Filing chart, so some spouses and children of green card holders in the U.S. may be able to file now.
Before you celebrate, check your country. Mexico moved weeks, not a year, and the Philippines and India’s F4 didn’t get the jump.

If you’re on an F-1 or J-1, you’ve probably heard that duration of status ended in September.
It didn’t. A federal judge blocked the new rule one day before it was supposed to start, so D/S still applies to your stay.
The government already appealed, though. So keep maintaining your status, talk to your DSO before you file or travel, and know your program end date in case things change.

If you’re on an H-1B, L-1, O-1 or TN visa, you’ve probably counted on having 60 days to figure things out if your job ends.
DHS wants to take that away. Under a new proposal, your status would end the day after your job does, and your spouse and kids would lose theirs at the same time.
Right now it’s only a proposal. The 60-day grace period still applies today. But this is the moment to know your dates, keep your documents ready and, if this affects you, leave a comment before November 10.

You’ve waited months. Maybe years. You know a mandamus lawsuit could get your case moving, but there’s one fear holding you back: “What if suing USCIS makes things worse?”
We hear this all the time, and it’s a fair thing to worry about. But going to court doesn’t give USCIS a reason to punish you. Your case is still decided on the law and what’s in your file. The $100,000 H-1B fee is blocked. Again!
On September 30, a federal court in California stopped the policies agencies use to collect it. That makes two courts. But the government already appealed, and if the Ninth Circuit pauses the ruling, the fee could come back with little warning.
And the layoff review from the September 18 executive order? Still in place. The ruling didn't touch it.
If you sponsor H-1B workers, this is not the moment to assume anything. Check the fee status before every filing, keep proof of any payment you already made, and get your layoff history lined up against each petition before an officer asks about it.
