DID YOU CHOOSE THE WRONG BVA DOCKET? | 3 VA Appeal Options Explained
🚨 BEFORE YOU FILE VA FORM 10182, WATCH THIS.
Did you choose the right Board of Veterans' Appeals (BVA) docket for your VA appeal?
Under the Appeals Modernization Act (AMA), veterans appealing a VA decision to the Board using VA Form 10182 generally have three review options:
🔹 Direct Review
🔹 Evidence Submission
🔹 Hearing
But here's the question many veterans don't ask: Which one is actually right for YOUR case?
Join us for tonight's The Veterans Claims Brief as we break down the three BVA dockets, explain what each one allows you to do, and discuss the strategic considerations veterans should understand before selecting an option.
🎯 WHAT WE'LL COVER
1️⃣ DIRECT REVIEW
What happens when you choose the Direct Review docket?
We'll explain:
• What evidence the Veterans Law Judge can consider
• Why you cannot submit new evidence on this docket
• Why no hearing is held
• Why Direct Review is generally the fastest Board option
• When Direct Review can make sense
• When choosing Direct Review could potentially be a strategic mistake
The key question:
If everything you need to win is already in your claims file, why wait for a hearing or an evidence window?
2️⃣ EVIDENCE SUBMISSION
What if you have evidence that wasn't part of the record when VA made its decision?
We'll discuss:
• New evidence
• Medical records
• Nexus opinions
• Buddy statements
• DBQs
• Lay statements
• The 90-day evidence window
• When Evidence Submission may be preferable to Direct Review
The key question:
Do you have evidence that could change the outcome that the Board hasn't considered yet?
3️⃣ HEARING DOCKET
Do you actually need to talk to a Veterans Law Judge?
We'll discuss:
• What happens during a BVA hearing
• What veterans should expect
• What testimony can and cannot accomplish
• Submitting evidence at or after the hearing
• The 90-day post-hearing evidence period
• Why the Hearing docket generally takes longer
• When a hearing may provide meaningful value
• When a hearing may be unnecessary
And we'll tackle an important misconception:
The Hearing docket isn't automatically the “strongest” docket simply because you get to speak with a judge.
⚠️ THE BIG QUESTION: IS THE FASTEST DOCKET REALLY THE BEST DOCKET?
VA currently identifies Direct Review as its fastest Board option, but processing times can vary.
We'll talk about why veterans shouldn't choose a docket simply because they want the quickest possible decision.
Instead, ask:
“What does the Board need to properly decide MY appeal?”
That is the strategic question.
🔥 BONUS TOPIC — IF TIME PERMITS
If we have enough time during the livestream, Jim and I will also tackle another area that creates tremendous confusion:
HLR INFORMAL CONFERENCE vs. SUPPLEMENTAL CLAIM HEARING
Veterans often hear the words “conference” and “hearing” and assume they're basically the same thing.
They're not.
We'll explain the difference between:
HIGHER-LEVEL REVIEW INFORMAL CONFERENCE - “VA got it wrong based on the evidence it already had.”
vs.
SUPPLEMENTAL CLAIM + HEARING - “I have new and relevant evidence that VA needs to consider.”
We'll discuss:
• What an HLR informal conference actually is
• Why an HLR does NOT allow new evidence
• What you can accomplish during an HLR conference
• What a hearing during the Supplemental Claim process means
• Why a Supplemental Claim is fundamentally different from an HLR
• When new and relevant evidence points toward a Supplemental Claim
• How to think strategically when you believe VA both made an error AND you have new evidence
And we'll answer the question: “Should I request an HLR or file a Supplemental Claim?”
